OLGAVI TERMS & CONDITIONS OF SALE AND USE

Welcome to olgavi.com (the "Site"), operated by Olgavi ("we," "us," or "our"). These Terms & Conditions ("Terms") govern your access to and use of the Site, including any purchase you make. By accessing or using the Site, you agree to be bound by these Terms.

1. ACCEPTANCE OF TERMS

By placing an order for products from this Site, you accept and are bound by these Terms. You must be at least 18 years of age to purchase products or services through this Site.

2. PRODUCT AND ORDER TERMS

2.1 Product Accuracy: We strive to display accurate product information, including color, features, and specifications. However, the accuracy of the images displayed will depend on the color capabilities of your monitor or device. All weights, measurements, and similar descriptions are approximate and are provided for convenience only.

2.2 Availability: All products are subject to availability. We reserve the right to discontinue any product at any time.

2.3 Order Acceptance and Cancellation: Your receipt of an order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept, decline, or limit your order for any reason. If we cancel an order after you have already been charged, we will refund the full amount.

3. PRICING, PAYMENT, AND INTERNATIONAL SALES

3.1 Pricing: All prices posted on this Site are subject to change without notice. The price charged will be the price in effect at the time the order is placed.

3.2 Payment: Terms of payment are within our sole discretion and, unless otherwise agreed, payment must be received by us prior to our acceptance of an order.

3.3 International Orders, Taxes, and Duties:

  • The prices displayed on the Site are typically exclusive of import duties, taxes, and other governmental charges that may be applicable to international orders.
  • The buyer/recipient is responsible for paying all tariffs, duties, customs fees, and taxes levied by the destination country. These charges are not included in the item price or shipping cost.
  • We will not be held responsible for any delay or failure to deliver caused by the customer's failure to pay these charges. If the recipient refuses to pay the duties and the shipment is returned to us, any resulting return costs will be deducted from the refund.

4. SHIPPING, DELIVERY, AND RISK OF LOSS

4.1 Shipping Estimates: Estimated delivery times are based on the country of destination and are not guaranteed. We are not liable for any delays in shipments.

4.2 Risk of Loss: Title and risk of loss for all products ordered by you pass to you upon our transfer of the products to the shipping carrier. This means we are not responsible for packages lost or damaged in transit after they leave our facility.

5. LIMITED WARRANTY AND RETURNS

5.1 Olgavi Limited Warranty: We offer a 1 Year Limited Warranty against manufacturing defects from the date of purchase. This warranty does not cover:

  • Normal wear and tear.
  • Battery life.
  • Damage resulting from improper handling, misuse, lack of care, accidents (e.g., impact, crushing, high temperature), or water damage not covered by the watch's water resistance rating.
  • Third-party modifications or repairs.

5.2 Returns and Exchanges:

  • You may return unused, undamaged items in their original packaging within 30 days of receipt for a refund or exchange.
  • The watch must be unworn, with all protective foils, tags, and documentation intact.
  • Customers are responsible for all return shipping costs, duties, and taxes.

6. INTELLECTUAL PROPERTY RIGHTS

The Site and all content, including but not limited to, the Olgavi brand name, logos, product images, and site design are the property of Olgavi or its licensors and are protected by international copyright and trademark laws. You may not use, reproduce, or distribute any content without our express written permission.

7. LIMITATION OF LIABILITY

In no event shall Olgavi, its affiliates, or their respective directors, officers, employees, or agents be liable to you or any third party for any consequential, incidental, indirect, exemplary, special, or punitive damages, including lost profits, arising from or relating to your use of this Site or any products purchased.

8. GOVERNING LAW AND JURISDICTION

8.1 Governing Law: These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of
The Republic of Singapore, without giving effect to any choice or conflict of law provision or rule.

8.2 Jurisdiction: Any legal suit, action, or proceeding arising out of or related to these Terms or the Site shall be instituted exclusively in the courts of The Courts of Singapore, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

9. ENTIRE AGREEMENT AND MODIFICATION

We reserve the right to amend these Terms at any time. The most current version of these Terms will supersede all previous versions. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms.
